NOTICE of Proposed Emergency Rulemaking and Informative Digest Released for the Klamath River Basin – Scott River and Shasta River Watersheds

Today, the State Water Resources Control Board released a Notice of Proposed Emergency Rulemaking (Notice) for continuation of Emergency Actions to Establish Minimum Instream Flow Requirements, Curtailment Authority, and Information Order Authority in the Klamath Watershed and the proposed rulemaking package.  The Notice provides a link to the proposed rulemaking package that includes an informative digest.  The informative digest includes a copy of the proposed emergency regulation, documents that provide context and justification for the emergency regulation, and a fiscal impacts analysis. 

The Notice and proposed rulemaking package are also available on the Scott River and Shasta River Watersheds Drought Response webpage and can be accessed by expanding the banner in the Drought Response Topics section titled “2022 Emergency Regulation Readoption Process”  (https://www.waterboards.ca.gov/waterrights/water_issues/programs/drought/scott_shasta_rivers/).

A previous draft of the proposed regulation was released by the Board, via email, on June 10, 2022, as part of Item No. 5, on the Board’s June 21, 2022 Agenda.  The Notice includes the most current version of the proposed regulation. 

Government Code section 11346.1, subdivision (a)(2), requires that, at least five working days prior to the submission of a proposed emergency action to the Office of Administrative Law (OAL), the adopting agency must provide a notice of the proposed emergency action to every person who has filed a request for notice of regulatory action with the agency. After the submission of the proposed emergency regulation to OAL, OAL shall allow interested persons five calendar days to submit comments on the proposed emergency regulations as set forth in Government Code section 11349.6.
