The emergency regulation for the Mill Creek and Deer Creek watersheds is effective today, Monday, October 4, 2021. The emergency regulation, as approved by the Office of Administrative Law, is also available with additional information on the Mill Creek and Deer Creek Drought Response webpage.
In this emergency rulemaking, the State Water Resources Control Board (State Water Board) adopted emergency curtailment and reporting regulations for Mill and Deer Creeks. Specifically, the emergency regulations (1) establish emergency drought minimum flow requirements to protect threatened Central Valley spring-run Chinook salmon and threatened California Central Valley steelhead; (2) ensure continued access to water supplies for minimum human health and safety needs; (3) permit local cooperative solutions in place of specified State Water Board-issued curtailment orders; (4) prohibit inefficient domestic lawn watering practices; and (5) require curtailment order reporting.
Limitations on domestic lawn watering: The requirement related to inefficient domestic lawn watering is effective immediately and is not dependent on curtailment orders. In accordance with the emergency regulation, all domestic lawn watering must be limited to no more than 18.5 gallons per day per 100 square feet.
