On August 19, 2020, the California Water Commission adopted emergency regulations providing Water Storage Investment Program applicants who previously did not receive early funding with an opportunity to apply for early funding for the completion of permits and environmental documentation. The Office of Administrative Law approved the emergency regulations on August 31, 2020, and they became effective immediately. Commission staff filed the Notice of Proposed Action with the Office of Administrative Law on November 17, 2020. This starts the formal rulemaking process to make the emergency regulations final. The notice of proposed rulemaking and proposed regulations are attached to this email. Additional information can be found on the Commission’s website. The proposed regulations do not change the amount of funding available to any applicant in the Water Storage Investment Program.
The public comment period for the proposed rulemaking begins November 27, 2020. To be considered by the Commission, written comments must be received no later than 5:00 p.m. on January 13, 2021. The Commission will conduct a public hearing via Zoom on January 20, 2021, at 9:30 a.m. Interested members of the public may present comments orally or in writing at the hearing and may provide comments by postal mail or by electronic submittal before the hearing.
