From the State Water Board:
On September 3, 2019, the Executive Director of the State Water Resources Control Board issued a letter denying without prejudice the water quality certification application for the Lower Klamath Project (Project).
In accordance with California Code of Regulation section 3836, when the period for water quality certification will expire before the State Water Board can review supplemental information and a required final environmental impact report, the State Water Board shall deny the water quality certification without prejudice.
The State Water Board continues to evaluate the Project’s impacts to water quality through review of comments received on its June 7, 2019 draft water quality certification, review and development of responses to comments provided on the December 27, 2018 Draft Environmental Impact Report (EIR) for the Project in preparation of a final EIR, and evaluation of supplemental information from the KRRC.
