The U.S. Army Corps of Engineers (USACE) Sacramento District has signed a Categorical Permission for Section 408 Requests. The signed Categorical Permission documents, including the programmatic environmental assessment and signed finding of no significant impact (FONSI), have been posted to the Sacramento District’s Section 408 Permission website: https://www.spk.usace.army.mil/408permissions/
The authority to grant permission for temporary or permanent use, occupation or alteration of any USACE federally authorized civil works project is contained in Section 14 of the Rivers and Harbors Act of 1899, as amended, codified at 33 U.S.C. 408 (Section 408). In accordance with Engineering Circular 1165-2-220, the Sacramento District has developed a Categorical Permission to expedite and streamline the review and decision process of Section 408 requests that are similar in nature and have similar impacts to the USACE project and the environment. The Sacramento District prepared a programmatic environmental assessment, which analyzes the effects of the Categorical Permission on the human environment and satisfies National Environmental Policy Act requirements. The Categorical Permission and FONSI were signed by the District Engineer on January 14, 2019.
