NOTICE OF PUBLIC COMMENT/WORKSHOP/HEARING: Proposed Establishment of the Water Control Plan for Inland Surface Waters, Enclosed Bays, and Estuaries of California; and Draft Toxicity Provisions

The State Water Resources Control Board (State Water Board) is proposing the Establishment of the Water Quality Control Plan for Inland Surface Waters, Enclosed Bays, and Estuaries of California; and Toxicity Provisions.

The Provisions would establish numeric water quality objectives for both acute and chronic toxicity and establish a program of implementation to control toxicity. The Provisions would provide consistent protection of aquatic life beneficial uses in inland surface waters, enclosed bays, and estuaries throughout the state, and protect aquatic habitats and life from the effects of known and unknown toxicants. The Provisions replace the State Water Board’s previous proposal to control toxicity, the Draft Toxicity Policy.

The State Water Board has posted the Notice of Opportunity for Public Comment, Public Staff Workshops, Public Hearing, and Notice of Filing for the proposed Establishment of the Water Control Plan for Inland Surface Waters, Enclosed Bays, and Estuaries of California; and Draft Toxicity Provisions (referred to as the “ISWEBE” and the “Toxicity Provisions”, respectively).

Document Availability:  On or before Friday, October 19, 2018, the Toxicity Provisions and Draft Staff Report, including the Draft Substitute Environmental Documentation will be available on the State Water Resources Control Board’s web site at: https://www.waterboards.ca.gov/water_issues/programs/state_implementation_policy/tx_ass_cntrl.html.

In addition, the response to comments regarding the previous proposed 2012 Draft Toxicity Policy will be available on the same State Water Board website on or before October 29, 2018.

The State Water Board will receive public comments on the proposed Toxicity Provisions and the Draft Staff Report, including the Draft Substitute Environmental Documentation. Two staff workshops will be held. The first will be held on Monday, October 29, 2018 in Costa Mesa, and the second will be held on Wednesday, October 31, 2018 in Sacramento. A public hearing will be held to receive public input and comments on Wednesday, November 28, in Sacramento.
