The Delta Stewardship Council reports that nine appeals have been filed for the Department of Water Resources’ (DWR) July 27, 2018 certification of consistency with the Delta Plan for its California WaterFix project.
The Delta Reform Act requires that any state or local agency doing a project in the Delta that meet the definition of a ‘covered action’ certify that those actions they are taking are consistent with the Delta Plan. Earlier this year, the Delta Stewardship Council adopted the Conveyance, Storage, and Operations amendment, which seemed to pave the way for the project. And as of the end of the weekend, with deadline being end of day Monday, no appeals had been posted on the Delta Stewardship Council’s website.
However, what a difference a day (or two) makes. Now, the parties appealing the determination include Delta stakeholder groups, Delta counties, and local agencies. The Council is required to hold a public hearing within 60 days, and issue a decision within 60 days after that.
