NOTICE OF OPPORTUNITY TO COMMENT Concerning PFOS and PFOA Revisions to an Amendment to the Policy for Water Quality Control for Recycled Water
NOTICE IS HEREBY GIVEN that the State Water Resources Control Board (State Water Board) will receive written public comments on revisions to a proposed amendment (Revised Proposed Amendment) to the Policy for Water Quality Control for Recycled Water (Recycled Water Policy) and the Revised Draft Staff Report, including the Draft Substitute Environmental Documentation (Revised Draft SR/SED) for the addition of perfluorooctane sulfonate (PFOS) and perfluorooctanoic acid (PFOA) to the monitoring list for potable recycled water projects. Information on the comment period and how to submit written comments is detailed below under “Submission of Written Comments.” The Revised Proposed Amendment and Revised Draft SR/SED do not yet include revisions in response to the May 9, 2018 to June 26, 2018 public comment period.
BACKGROUND
The Recycled Water Policy includes provisions that require staff to reconvene a science advisory panel every five years to provide guidance on future actions related to constituents of emerging concern (CECs) in recycled water. Resolution No. 2016-0061 directed State Water Board staff to reconvene a Science Advisory Panel on CECs in recycled water (Panel) and to propose an amendment to the Recycled Water Policy considering feedback received from stakeholder outreach, the findings of the Panel, and an evaluation of the challenges and benefits of salt and nutrient management plan development.
The State Water Board previously held a public comment period from May 9, 2018 to
June 26, 2018 and held a public hearing on June 19, 2018 to receive public input and comments on the Proposed Amendment. State Water Board staff is reviewing these comments.
ADDITION OF PFOS AND PFOA
On July 13, 2018, the State Water Board Division of Drinking Water issued Notification Levels for perfluorooctane sulfonate (PFOS) and for perfluorooctanoic acid (PFOA). State Water Board staff requested the Science Advisory Panel on CECs in Recycled Water re-evaluate PFOS and PFOA considering the new Notification Levels and determine if they should be added to the CEC monitoring list in the Proposed Amendment. Upon review, the Panel recommended adding PFOS and PFOA to the CEC monitoring list for potable recycled water projects and staff revised the May 9, 2018 draft of the Proposed Amendment and Draft SR/SED to reflect this recommendation. The only changes to the Revised Proposed Amendment are the addition of PFOS and PFOA to the list of health-based CECs (see Table 1 and Table 7 in Attachment A of the Revised Proposed Amendment) and supporting information in the Revised Draft SR/SED (see section 4.14.1 of the Revised Draft SR/SED, p. 70-72).
