Please note that the Delta Stewardship Council has placed itself under ex parte communication restrictions regarding the California WaterFix certification of consistency. Councilmembers, Council staff and consultants will not communicate about the California WaterFix with any person outside of the Council. The one exception is communications regarding the administrative or procedural status of the project, which should be directed to: waterfixcert@deltacouncil.ca.gov. Please see the Council’s Ex Parte Notice for more details.
Notes Regarding Appeals:
(1) Any person who claims that this covered action is inconsistent with the Delta Plan and, as a result of that inconsistency, that action will have a significant adverse impact on the achievement of one or both of the coequal goals of the Delta Reform Act (Water Code § 85054) or implementation of government sponsored flood control programs to reduce risks to people and property in the Delta, may file an appeal with regard to this certification of consistency no later than 30 calendar days after the date of submittal of the certification of consistency. Please see the Council’s Administrative Procedures Governing Appeals for more information regarding the appeal process. You may submit an appeal by viewing the profile summary, clicking the “Submit an Appeal” button and completing the online form.
(2) If you anticipate filing an appeal, please review the documents submitted by the certifying agency at the profile summary and cite to those documents as part of your appeal. DO NOT SUBMIT DUPLICATES OF DOCUMENTS SUBMITTED BY THE CERTIFYING AGENCY.
