CALIFORNIA WATER FIX: DWR Letter: Public Availability of Sufficient Information to Notice Part 2 of the California WaterFix water rights change petition hearing

Letter from the Department of Water Resources to the Hearing Officers

Dear Hearing Officers,

On Monday, July 31, 2017, the California Department of Water Resources (“DWR”) submitted notice to the hearing team and parties for the California WaterFix water rights change petition hearing regarding the availability of the final National Marine Fisheries Service Biological Opinion, final U.S. Fish and Wildlife Service Biological Opinion (both issued June 26, 2017), final California Department of Fish and Wildlife section 2081(b) Incidental Take Permit (issued July 26, 2017), and certified Final Environmental Impact Report / Environmental Impact Statement and Notice of Determination (issued July 21, 2017).  As stated in that notice, the U. S. Bureau of Reclamation has not yet determined when a Record of Decision will be issued.

Because there is no definitive schedule for the issuance of the Record of Decision and because DWR believes that the substantive information necessary to notice Part 2 of the water rights hearing is publicly available and any delays may negatively affect the continuity of the evidentiary record, and DWR respectfully requests the Hearing Officers issue the notice for Part 2 of the California WaterFix water rights change petition hearing.
