This just in … Notice of Petition Requesting Changes in Water Rights of DWR and USBR for the California WaterFix, Public hearings scheduled; Public Notice Posted for the California WaterFix Project – Water Quality Certification Application

This afternoon, there are two notices from the State Water Resources Control Board:

1. Notice of Petition Requesting Changes in Water Rights of DWR and USBR for the California WaterFix and Notice of Public Hearing and Pre-Hearing Conference to Consider the Petition

SWRCB logo water boardsThis is to advise interested persons that, on October 30, 2015, the State Water Resources Control Board (State Water Board) issued a combined notice of: (1) the California Department of Water Resources’ (DWR) and the U.S. Bureau of Reclamation’s (Reclamation) joint petition (hereinafter “Petition”) to add three new points of diversion and/or points of rediversion of water to 15 water right permits for the State Water Project (SWP) and  the Central Valley Project (CVP) associated with the California WaterFix Project; and (2) an evidentiary hearing to consider the Petition.  The State Water Board will also hold a pre-hearing conference to organize the conduct of the hearing on January 28, 2016 and January 29, 2016, if necessary.

The hearing is planned to be conducted in two parts.  The first part of the hearing will focus on the potential effects of the Petition on agricultural, municipal and industrial users of water and conditions that should be placed on any approval of the Petition to protect those users.  The second part of the hearing will focus on the potential effects of the Petition on fish and wildlife and recreational uses and conditions that should be placed on any approval of the Petition to protect those uses, including consideration of appropriate Delta flow criteria for the California WaterFix Project.  Part I of the evidentiary hearing is planned to commence on Thursday, April 7, 2016.   Part II of the hearing is not planned to commence until after the environmental and endangered species act compliance processes are completed.  The key California WaterFix hearing dates are as follows:

 

9:00 a.m., Thursday, January 28, 2016: Pre-hearing conference to discuss the scope of the hearing and procedural issues, and continuing, if necessary, on Friday, January 29, 2016

12:00 noon, Tuesday, January 5, 2016: Deadline for receipt of protests against Petition and Notices of Intent to Appear for Parts I and II of the hearing.

12:00 noon, Tuesday, March 1, 2016: Deadline for receipt and service of witnesses’ proposed testimony, witness qualifications, exhibits, lists of exhibits, and a statement of service for Part I of the hearing.

9:00 a.m., Thursday, April 7, 2016:  Commencement of Part I of the hearing.

Date to be announced:   Deadline for receipt and service of witnesses’ proposed testimony, witness qualifications, exhibits, lists of exhibits, and a statement of service for Part II of the hearing.

Dates to be announced:  Commencement of Part II of the hearing.                 

The hearing and pre-hearing conference will be held in the Joe Serna Jr. Cal EPA Building, 1001 I Street, Second Floor, Sacramento, CA 95814.
