“On November 12, 2013, the Sacramento Superior Court issued a Final Statement of Decision invalidating the State Water Resources Control Board’s (SWRCB) annual water right fee regulations adopted in 2003-2004.
This case is on remand from the California Supreme Court in California Farm Bureau Federation v. State Water Resources Control Board (2011) 51 Cal.4th 421. Various petitioners, including the Northern California Water Association, Central Valley Project Water Association, California Farm Bureau Federation, Imperial Irrigation District, Westlands Water District, and other water right holders challenged the annual water right fees in 2003, alleging the fees violated, among other things, Proposition 13 and the Supremacy Clause of the United States Constitution. … “
